Barrasso Statement on Federal Court’s Decision to Strike Down the Affordable Clean Energy Rule
WASHINGTON, D.C. — Today, U.S. Senator John Barrasso (R-WY) released the following statement on a federal appeals court’s decision to strike down the Affordable Clean Energy (ACE) rule. The ACE rule repealed and replaced the Obama administration’s so-called Clean Power Plan rule.
“Two activist judges on the court seem intent on clearing the decks for the incoming Biden administration to issue punishing new climate regulations,” said Barrasso. “Such regulations will result in fewer jobs and higher energy costs. Obama-era regulations would have mandated the shutdown of power plants and increased energy costs for families in Wyoming and across the country. The ACE Rule is commonsense policy to protect our air and allow our economy to grow. Americans deserve clean air and clear rules. This decision gives them neither.”

On June 19, 2019, the Trump administration finalized the ACE Rule.
On August 21, 2018, the EPA proposed the Affordable Clean Energy rule to replace the Clean Power Plan rule.
On March 27, 2018, Barrasso participated in an EPA-held listening session in Gillette, WY on the proposed repeal of the Obama administration’s so-called Clean Power Plan regulation.
On January 12, 2018, Barrasso and every Republican member of the EPW committee sent a letter to EPA in support of the proposed repeal of the Clean Power Plan.
